1. Acceptance of Terms

We are not a law firm, a credit-reporting agency, a bank, a money-services business, or a real-estate broker. You are responsible for how you use the Services and for complying with all laws that apply to you. 3. Accounts and Eligibility
To use most features you must register for an account. You must be at least 18 years old and capable of forming a binding contract. 4. Subscription, Billing, and Cancellation
Paid features are offered on a subscription basis. Smartlord.ai uses a per-unit pricing model: the recurring fee scales with the number of rental units in your account, billed monthly or annually as you select at checkout. A flat base covers a small number of units, with a graduated per-unit rate applied above that, and larger portfolios above the self-serve ceiling are handled through a custom plan. Current prices, units, and any included allowances are shown on our pricing page and in your in-app billing screen at the time of purchase, which control over any general description here. We do not list specific prices in these Terms so that the pricing page remains the single source of truth.
Unless stated otherwise, subscriptions renew automatically at the end of each billing period using your payment method on file, at the then-current rate, until cancelled. By subscribing, you authorize us and our payment processor to charge the applicable recurring fee and any taxes. If your unit count changes during a period, your charge may be adjusted on a subsequent invoice to reflect the new count.
You may cancel your subscription at any time from your in-app billing settings or by contacting [email protected]. Cancellation stops future renewals; it generally takes effect at the end of the current billing period, and you retain access to paid features until then. Except where required by law, fees already paid are non-refundable and we do not provide prorated refunds for partial periods. 5. Payments Processed via Stripe
Subscription charges and tenant rent payments are processed by Stripe, Inc. ("Stripe"). Smartlord.ai is a technology platform that facilitates payments; it is not a bank, money transmitter, or payment processor, and it does not take ownership of rent funds. Funds collected from tenants are routed to a landlord's connected Stripe account.
To collect payments, landlords must register a Stripe connected account and agree to the applicable Stripe terms, including the Stripe Connected Account Agreement and the Stripe Services Agreement. Your use of payment features is also governed by those agreements, and Stripe may require identity and business verification before enabling payouts.
Processing fees, payout timing, and the allocation of fees between landlord and tenant are described in your in-app billing and payment screens and may change. You are solely responsible for chargebacks, reversals, refunds, returned or insufficient-funds (NSF) transactions, and any related fees or losses. To the extent permitted by law, Smartlord.ai is not liable for losses arising from payment disputes, fraud, or processor decisions. Automated collection workflows, including reminders, scheduled charges, and late-fee assessment, run according to your settings and your lease terms; you are responsible for confirming that any late fee or notice is lawful and permitted by your lease and by applicable state and local law.
6. Acceptable Use
You agree to use the Services only for lawful purposes and in compliance with these Terms. You will not, and will not permit anyone to:
- violate any law, regulation, or third-party right, including fair-housing, consumer-protection, privacy, and tenant-screening laws;
- request, access, or use background, credit, or screening reports without a permissible purpose and the consents required by law;
- post false, misleading, discriminatory, or fraudulent listings, applications, or other content;
- upload malware, attempt to gain unauthorized access to the Services or other accounts, probe or test security, or interfere with normal operation;
- scrape, harvest, or collect data from the Services except as expressly allowed, or use the Services to send spam or unlawful communications;
- reverse engineer, copy, resell, or create derivative products from the Services except to the extent the law prohibits this restriction; or
- misuse AI-generated output, including representing it as legal advice or as reviewed by an attorney.
We may investigate suspected violations and may suspend or terminate access, remove content, or take other action we consider appropriate, in each case where permitted by law.
7. Landlord Responsibilities
Compliance is your responsibility. Smartlord.ai gives you tools and information, but you, the landlord, are solely responsible for operating your rental business lawfully. This includes, without limitation:
- Fair housing. You must comply with the federal Fair Housing Act and all applicable state and local fair-housing and anti-discrimination laws in your listings, advertising, screening criteria, application handling, and leasing decisions. - Lawful use of screening. You are responsible for using tenant screening only with a permissible purpose, obtaining required applicant consents, applying consistent and lawful criteria, and providing any adverse-action and other notices required by the Fair Credit Reporting Act (FCRA) and applicable state and local law.
- Accuracy of listings and documents. You are responsible for the accuracy, completeness, and legality of your listings, pricing, disclosures, lease terms, notices, and other content you create or send using the Services, including documents generated with AI assistance.
- Local and contractual obligations. You are responsible for licensing, registration, habitability, security-deposit handling, notice periods, rent-control or rent-stabilization rules, and all other obligations that apply to your properties and tenants.
You agree that you, and not Smartlord.ai, are the decision-maker for all leasing, screening, pricing, and tenancy decisions. We recommend you have a qualified attorney review documents and screening practices before you rely on them.
8. Tenant Screening Disclaimer
Tenant screening reports, including credit, criminal, eviction, identity, employment, and income-related checks, are provided through third-party consumer-reporting and verification partners, including Checkr, and in some cases are fulfilled manually by our team before being delivered to you. Smartlord.ai is not a consumer-reporting agency and does not generate the underlying report data.
Smartlord.ai provides screening tools and reports, not legal advice or a credit, rental, or hiring decision. We do not recommend, endorse, or require that you approve or deny any applicant. The accuracy, completeness, and timeliness of report data are the responsibility of the reporting source, and results may be limited by available records. You are solely responsible for interpreting reports, applying lawful and consistent criteria, and making your own leasing decision, as well as for any required consents and adverse-action notices (see Sections 6 and 7). If you believe report data is inaccurate, the applicant may have dispute rights with the reporting agency under the FCRA.
9. User Content and License
"User Content" means the content and data you submit to or create through the Services, including listings, photos, application data, documents, messages, and records about properties, tenants, and applicants. As between you and Smartlord.ai, you retain ownership of your User Content. You are responsible for having the rights and any consents needed to submit it and for its accuracy and legality.
You grant Smartlord.ai a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and adapt your User Content as needed to operate, secure, support, and improve the Services, to provide features you request, and to comply with law. This includes sharing relevant data with the third-party processors described in these Terms (for example, sending payment details to Stripe or applicant details to Checkr) and creating backups. We may use de-identified or aggregated data that does not identify you, your tenants, or applicants for analytics and product improvement. Our handling of personal information is described in our Privacy Policy. You are responsible for maintaining your own copies of important records.
10. Intellectual Property
The Services, including the software, design, text, graphics, logos, and the Smartlord.ai name and marks, and all related intellectual-property rights, are owned by Smartlord.ai or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal property-management purposes during your subscription. Except for this license and your rights in your own User Content, no rights are granted to you. You may not use our names, logos, or marks without our prior written permission. Document templates and AI-generated drafts are provided for your use within the Services; we retain rights in the underlying templates and software. If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without obligation to you.
11. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, that AI-generated documents are accurate, complete, or legally sufficient, or that screening data is accurate or complete. We are not responsible for the acts, omissions, products, or services of third parties, including Stripe, Checkr, Google, tenants, applicants, or vendors.
To the maximum extent permitted by law, Smartlord.ai and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost rental income, lost data, or business interruption, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services or these Terms is limited to the amount you paid us for the Services in the [liability cap period, e.g. twelve (12) months, to be confirmed by counsel] preceding the event giving rise to the claim. 12. Indemnification

We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.
13. Termination
You may stop using the Services and close your account at any time, subject to the billing and cancellation terms in Section 4. We may suspend or terminate your access, in whole or in part, at any time if you violate these Terms, if required by law, to protect the Services or other users, or, with notice as required, for convenience. Upon termination, your right to use the Services ends. We may retain and delete your data in accordance with our Privacy Policy and applicable law; specific retention periods are described there and any final periods are [retention period to be confirmed]. We encourage you to export important records before closing your account. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, indemnification, intellectual property, and governing law) will survive.
14. Governing Law
