1. Acceptance of Terms

By accessing or using the SmartLord.ai platform, services, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to all the terms, you may not use the Services.

2. AI-Generated Documents & Legal Disclaimer

SmartLord.ai is not a law firm and does not provide legal advice. The AI Lease Builder, translation tools, and document templates provided are for informational and self-help purposes only. While our Artificial Intelligence models are trained on general legal frameworks, real estate laws vary by state and municipality and change frequently. You agree that any lease generated is used at your own risk, and we highly recommend having an attorney review any documents before execution.

3. Tenant Screening (FCRA Compliance)

SmartLord.ai integrates with TransUnion to provide credit, criminal, and eviction reports. If you use these features as a Landlord, you certify that you are the legitimate owner or manager of the property and have a permissible purpose under the Fair Credit Reporting Act (FCRA). You agree to provide tenants with adverse action notices when required by law if you deny their application based on these reports.

4. Payments & Rent Collection

The Role of SmartLord.ai: ISBAH 360 LLC ("SmartLord.ai") provides a technology platform that facilitates the collection of rent, late fees, and other property-related payments from tenants. SmartLord.ai is a technology intermediary, not a bank, money services business, or payment processor. We do not hold, transmit, or take ownership of your funds at any time.

Third-Party Payment Processor (Stripe): Payment processing services for Landlords on SmartLord.ai are provided by Stripe, Inc. ("Stripe"). To use these features, you must register for a Stripe Express connected account. By setting up a payment account, you agree to be bound by the Stripe Connected Account Agreement and the Stripe Services Agreement.

Fee Structure and Payouts: Standard ACH bank transfers are free for the Landlord. A platform processing fee is applied to the transaction and paid directly by the Tenant at the time of payment. Funds collected from tenants are routed directly to your connected Stripe account via destination charges.

Automated Collections & Late Fees: SmartLord.ai enforces automated collection workflows. In the event of a failed payment, the system may automatically apply late fees in accordance with the executed lease and trigger progressive delinquency notices (e.g., Notice to Pay or Quit) unless manually paused or cancelled by the Landlord.

Disputes and Reversals: You are solely responsible for all reversed or charged-back transactions. SmartLord.ai is not liable for any losses, fees, or penalties resulting from tenant payment disputes, insufficient funds (NSF), or fraudulent transactions.

5. Limitation of Liability

To the maximum extent permitted by law, SmartLord.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or rental income, resulting from your use of the Services or AI-generated materials.
